These Terms of Service ("Terms") are a legal agreement between you and Break Project LLC, a California limited liability company doing business as Break Project ("Break Project," "we," "us," or "our"), headquartered in California, United States. They govern your use of https://breakproject.com, our contact and support channels, and our mobile applications available on the Apple App Store and Google Play.
If you do not agree to these Terms, do not use our services. Your use of our services is also subject to our Privacy Policy, which describes how we collect and use personal information in compliance with applicable U.S. and California privacy laws.

We may update, suspend, or discontinue any part of our services at any time, with or without notice, to the extent permitted by law and app store rules.

Some apps, including financial planning tools, are intended for adults. You are responsible for ensuring you meet any age or eligibility requirements for a specific app.
Certain apps may require you to create an account. You agree to provide accurate information and keep your credentials secure. You are responsible for activity under your account.
Notify us immediately at hello@breakproject.com if you suspect unauthorized access. You may request account deletion as described in our Privacy Policy.

We may suspend or terminate access if we reasonably believe you have violated these Terms.
Subject to these Terms and applicable app store terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use our mobile apps for personal, non-commercial use on devices you own or control.
You do not acquire ownership of the apps or any content within them. Apple App Store and Google Play terms also apply to downloads and in-app purchases.
Some apps may offer paid features or subscriptions processed by Apple or Google. Pricing, billing cycles, renewals, and refunds are handled according to the applicable app store policies and the terms shown at the time of purchase.
Under California's Automatic Renewal Law, subscription terms and cancellation methods must be clearly disclosed before purchase. Manage or cancel subscriptions through your Apple or Google account settings.

Our apps and website content are provided for general informational purposes only. They do not constitute financial, investment, tax, legal, or other professional advice.
Apps such as HENRY Wallet and Fear & Greed Meter are tools to help you organize information or view market sentiment. You are solely responsible for your financial decisions. Consult qualified professionals before making investment or planning decisions.
Our website, apps, logos, designs, text, graphics, and software are owned by Break Project LLC or our licensors and are protected by U.S. and international intellectual property laws. Except for the limited license above, no rights are granted to you.
You may not copy, modify, distribute, sell, or create derivative works from our content without our prior written permission.
If you submit content to us (for example, through a contact form or support email), you grant us a non-exclusive license to use that content to respond to you and operate our business. You represent that you have the right to submit the content and that it does not violate these Terms or any third-party rights.
Our services may link to or integrate with third-party websites, APIs, or platforms. We are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY INFORMATION WILL BE ACCURATE OR COMPLETE.
Some jurisdictions, including California, do not allow certain warranty exclusions. In those jurisdictions, disclaimers apply only to the extent permitted by law.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BREAK PROJECT LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OUR SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR OUR SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE RELEVANT SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $100.
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud or willful misconduct.
You agree to indemnify and hold harmless Break Project LLC from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of our services, your violation of these Terms, or your violation of any rights of another person or entity.
If you download our apps from the Apple App Store or Google Play, the applicable store terms also govern your use. In the event of a conflict between these Terms and mandatory app store terms, the app store terms control only to the extent required.
Apple and Google are third-party beneficiaries of certain provisions related to app distribution, as required by their platform policies.
These Terms are governed by the laws of the State of California and applicable federal laws of the United States, without regard to conflict-of-law principles that would require the application of another jurisdiction's laws.
If you are a California resident, you may also have rights under California consumer protection laws that cannot be waived by contract.
Except where prohibited by law, you and Break Project LLC agree that any dispute arising out of or relating to these Terms or our services will be resolved exclusively in the state or federal courts located in California, and you consent to personal jurisdiction in those courts.
Before filing a claim, you agree to contact us at hello@breakproject.com and attempt to resolve the dispute informally.
We may modify these Terms at any time by posting an updated version on this page. Continued use of our services after changes become effective constitutes acceptance of the revised Terms. If you do not agree, stop using our services.
